1. Introduction

Welcome to Ample Health & Wellness! These Terms of Service (“Terms”) govern your use of our website and services. By accessing or using our site, you agree to abide and be bound by these Terms at all times. If you do not agree, please do not utilize our services.

2. Intellectual Property

All content on our website, including text, graphics, logos, downloadable materials, and software, is the intellectual property of Ample Health & Wellness or our licensors. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

7. Sale of Services

We offer various holistic health and wellness services for purchase. By placing an order, you agree to provide accurate payment information and consent to the processing of your payment. All sales are subject to the terms outlined in this agreement.

Some of the services we provide may include the use of third-party websites or linked sites. These external platforms are used to enhance our offerings; however, we do not control or endorse the content or practices of these sites. Your use of third-party services is at your own risk and subject to the terms of those providers. Furthermore, all services, content, and materials provided through these third-party platforms are for personal use only and may not be reproduced, sold, or redistributed in any form without prior written consent from Ample Health & Wellness. Unauthorized reproduction, modification, or resale of our services or materials is strictly prohibited and may result in legal action.

9. Subscriptions/Memberships

If you subscribe to any of our services or memberships, your subscription will automatically renew unless canceled before the renewal date. You may cancel your subscription at any time, but no refunds will be provided for any unused portion of the subscription term.

10. Payments

All payments are due at the time of service unless otherwise specified. We accept various forms of credit cards for payment as indicated on our website. Providing your payment information to us, authorizes us to use and access the credit card you have chosen to use for our services. Failure to make timely payments may result in the suspension or termination of your access to our services.

11. Refunds

Refunds are available for group or individual paid-for coaching appointments if cancelled 24 hours before the scheduled date. If cancelled within a 24-hour period, a 20 percent cancellation fee will be deducted before a refund will be issued. However, if actively receiving individual or group coaching sessions, refunds are only available for the remaining time not utilized. A percentage of the paid fee will be designated by the staff of Ample Health & Wellness and this fee amount will be assessed and deducted for the time utilized and any program information distributed.

When participating in health challenges or wellness programs (self-paced, evergreen, or fixed date), refunds are not available. As these challenges or programs have tailored materials assigned and distributed to the participants at the onset of the challenge or program and participants may continue to utilize or have access to these materials after a challenge or program has completed.

12. Consumer Protection Law

Nothing in these Terms is intended to exclude, limit, or modify any rights or remedies you may have under consumer protection laws. If any provision of these Terms is found to be unenforceable under such laws, it shall not affect the enforceability of the remaining provisions.

13. Links to Other Websites

Our website may include links to other websites for your convenience. We do not endorse or control these sites and are not responsible for their content, accuracy, or practices. Your use of linked websites is at your own risk.

14. Limitation of Liability

To the maximum extent permitted by law, Ample Health & Wellness is not liable for any direct, indirect, incidental, or consequential damages arising from your use of our website or services. This includes, but is not limited to, damages for loss of profits, data, or other intangibles.

Results from health coaching services are not guaranteed, as individual outcomes may vary based on a variety of factors, including personal commitment, health status, and lifestyle choices. While health coaching may offer benefits such as improved well-being, better nutrition, and enhanced mindfulness, it is important to note that there are potential risks, including but not limited to, physical, emotional, or psychological discomfort during the process.

Health coaching is not a substitute for professional medical advice, diagnosis, or treatment. If you have concerns about your health, we strongly encourage you to consult with your healthcare provider before beginning any coaching program. Alternative approaches to health improvement, including but not limited to traditional medical care, therapy, and self-guided wellness practices, are available and should be considered as options.

15. Indemnity

You agree to indemnify, defend, protect, and hold harmless Kisha Pickford and Ample Health & Wellness; and their respective officers, directors, employees, stockholders, assigns, successors and affiliates (Indemnified Parties) from, against and in respect of all liabilities, losses, claims, damages, judgements, settlement payments, deficiencies, penalties, fines, interest and costs, expenses suffered, sustained, incurred or paid by the indemnified parties, in connection with, results from or arising out of, directly or indirectly, by Kisha Pickford and Ample Health & Wellness; rendering coaching services, recommendations, and/or any and all types of advice, my failure to disclose all relevant information regarding my medical and physical condition, acts or omissions, by Kisha Pickford and Ample Health & Wellness; harm or injury resulting from any advice or recommendations provided directly or indirectly by Kisha Pickford and Ample Health & Wellness;. You are aware of the potential beneficial and adverse effects associated with health and wellness coaching services, accept all the risks involved in implementing any advice and/or recommendations and will not seek indemnification or damages from the indemnified parties.

16. Applicable Law

These Terms are governed by the laws of Wyoming, United States of America. Any disputes arising from these Terms, or your use of our services will be subject to the exclusive jurisdiction of the courts in Sheridan, Wyoming, United States of America.

17. Dispute Resolution

In the event of a dispute, we encourage you to contact us first to seek a resolution. If a dispute cannot be resolved amicably, it may be submitted to binding arbitration or small claims court, depending on the nature of the dispute and applicable law.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes your acceptance of the new Terms.
